Broadcom said Wednesday a U.S. appeals court let stand a lower court order barring wireless chipmaker Qualcomm from selling chips that infringe on three of its patents.
The U.S. Court of Appeals for the Federal Circuit in Washington, D.C. rejected a bid by Qualcomm to lift a California trial court’s injunction that stopped it from selling chips found by a California jury in 2007 to infringe on the Broadcom patents.
Qualcomm wanted to continue selling the third-generation, or 3G, WCDMA chips while it appealed that verdict.
The appeals court, in its ruling on Tuesday, also dismissed an attempt by Sprint Nextel to intervene in the case.
“We are gratified that the U.S. Court of Appeals rejected Qualcomm’s motion for a stay, leaving in force the injunction against Qualcomm’s infringement issued by the U.S. District Court in Santa Ana,” Broadcom General Counsel David Dull said in a statement.
A Qualcomm spokeswoman said although the motion for a stay was denied, the appeals court granted the company’s request for an expedited schedule.
WCDMA mobile wireless technology provides much higher data speeds to mobile and portable wireless devices than most North American networks.
Under U.S. District Judge James Selna’s order, Qualcomm also must pay mandatory royalties to Broadcom for the chips it sells during the “sunset period” ending January 31, 2009.
Selna ruled that after the “sunset” date, Qualcomm would be permanently barred from infringing the three Broadcom patents.
Sprint Nextel Corp plans to put a walkie-talkie-style feature, which it called QChat, covered by one of the Broadcom patents in phones in the first quarter of 2008 using Qualcomm chips.
Qualcomm has said the injunction on 3G chips would hurt in the short term, but it promised to have alternative products in phones before the end of the current quarter.
A Canadian university has instilled a culture of fear by threatening to expel a student for cheating because he set up an online study group on Facebook, critics said this week.
Toronto’s Ryerson University threatened to expel first-year computer engineering student Chris Avenir last week, arguing that his study group on the Facebook networking site might encourage cheating.
Ryerson decided to lift the expulsion threat on Tuesday, but Avenir will get zero credits for the course work discussed on the Facebook forum last autumn, and the university has put a disciplinary notice on his record.
Canadian media analyst Jesse Hirsh said Ryerson’s actions send the wrong message to students, most of whom spend a lot of their time on the Internet.
“It sends a clear signal to all the kids that innovation is not only frowned upon but will be punished, and that if you use emerging technologies in innovative ways, you risk being expelled from the school,” he said.
But James Norrie, director of the School of Information Technology Management at Ryerson, on Thursday said the issue is one of accountability, whether online or offline.
“This is nothing to with technology. How can it possibility create a climate of fear?” he said.
Members of the Facebook study group–Dungeons/Mastering Chemistry Solutions–said the group was set up for students to help each other with homework assignments and to understand class lectures, and had nothing to do with cheating.
Ryerson, however, said the group offered the potential for cheating on a large scale.
In an interview, University of Toronto philosophy and media studies professor Megan Boler said all universities encourage collegiality and discussion, and that meeting online is actually very transparent because there are traces and records of everything discussed.
“Of course we want to ensure academic integrity, but I think academic freedom and civil rights are equally important, unless we expect students to study in total isolation,” she said.
A California bill that could lead to a tax on Internet music downloads faces slim odds of success, but the Democrat who wrote it says a debate over taxing such online retail transactions is overdue.
Assemblyman Charles Calderon told Reuters late on Thursday that California should consider imposing a tax on entertainment downloaded from online merchants such as Apple’s iTunes that is similar to the state’s levy on music compact discs sold in stores.
Sales taxes should apply equally to online and in-store purchases, and California is missing out on revenues from the rise of Internet retailers, Calderon said.
“If you walk into Wal-Mart and buy a CD, you walk out paying a tax,” Calderon said. “I don’t think we’re talking about a new tax here. We’re talking about whether our laws should keep up with the economy.”
Calderon’s bill would require California’s Board of Equalization to report to lawmakers on the potential for imposing a sales tax on electronic transmissions of information.
For Republican lawmakers, that is too close to a new tax.
They will kill the bill along with other legislation Democrats advance to raise existing taxes or introduce new ones, Mike Villines, the state Assembly’s Republican leader told Reuters. “We just disagree with it on the merits,” he said.
Calderon’s bill comes as California faces a $7.5 billion state budget shortfall. Republican Gov. Arnold Schwarzenegger has ruled out raising taxes to fill it and has instead proposed deep spending cuts.
Democratic lawmakers say the proposed cuts are drastic and some are urging tax plans to help close the shortfall, which is taking on added urgency in the state capital of Sacramento as school districts across the state prepare for reduced state financial aid.
Many are beginning to issue layoff notices to bolster their finances, and education groups are increasing pressure on lawmakers, especially Democrats, to defend education from spending cuts.
Democrats failed earlier this week to pass a bill through the state Assembly that would have imposed a tax on oil companies–a 6 percent levy on oil production and 2 percent on profits exceeding $10 million a year–and used proceeds for school spending.
The bill fell short of a required two-thirds support as all Assembly Republicans voted it down.
Billy Bragg: Let us decide how to exploit our own music

Sometimes there are words that really reverberate with people. What Thomas Jefferson wrote in the preamble to the U.S. Constitution is one. I think Barack Obama’s disquisition on race in America is another. I’m curious to know how the smackdown Billy Bragg delivered to the social-networking moguls is going to be received.
If history’s any guide, his New York Times op-ed on Saturday called “The Royalty Scam” will fall on deaf ears. Still, it’s worth a serious hearing.
Best as I can tell, Bragg isn’t a technophobe trying to turn back the clock. Rather, he’s concerned about the livelihood of his profession and he wants to know how musicians will make a living in the cyberage.
“The musicians who posted their work on Bebo.com are no different from investors in a start-up enterprise. Their investment is the content provided for free while the site has no liquid assets. Now that the business has reaped huge benefits, surely they deserve a dividend.
What’s at stake here is more than just the morality of the market. The huge social networking sites that seek to use music as free content are as much to blame for the malaise currently affecting the industry as the music lover who downloads songs for free. Both the corporations and the kids, it seems, want the use of our music without having to pay for it.
The claim that sites such as MySpace and Bebo are doing us a favor by promoting our work is disingenuous. Radio stations also promote our work, but they pay us a royalty that recognizes our contribution to their business. Why should that not apply to the Internet, too?”
He doesn’t answer the questions he raises. But Bragg does recommend the creation of rules of the road to let artists “decide how our music is exploited and by whom.” Rules? Consensus? Hoo boy, I can already hear the outrage, punctuated by dismissive peals of laughter. Too bad. He deserves a serious hearing. Now it’s your turn.
